1. General Provisions

1.1. This Public Offer Agreement (hereinafter referred to as the "Agreement") is an official offer by Sole Proprietor (FOP) Korshunova Sofiia Oleksandrivna, identification code 3794511224 (hereinafter referred to as the "Seller"), to conclude a contract for the purchase and sale of goods by means of remote communication via the NOIRE online store located at noire-magazine.com (hereinafter referred to as the "Online Store").

1.2. By placing an order through the Online Store, the Buyer accepts the terms of this Agreement in accordance with Articles 633, 641, and 642 of the Civil Code of Ukraine.

1.3. The Seller reserves the right to amend the terms of this Agreement unilaterally without prior notice to the Buyer. Any changes shall become effective from the moment of their publication on the Online Store website.

2. Subject of the Agreement

2.1. The Seller undertakes to transfer ownership of the goods to the Buyer, and the Buyer agrees to pay for and accept the goods under the terms of this Agreement.

2.2. This Agreement governs the purchase and sale of goods through the Online Store, including:

The Buyer's voluntary selection of goods in the Online Store;

The Buyer's independent placement of an order via the Online Store's interface;

The Buyer's payment for the order;

The delivery of the order to the Buyer.

3. Order Placement

3.1. The Buyer independently places an order through the Online Store's interface.

3.2. The Seller is not responsible for the accuracy and correctness of the information provided by the Buyer when placing an order.

4. Price of Goods

4.1. The price of goods is indicated in the Online Store in Ukrainian hryvnias (UAH) and includes all applicable taxes.

4.2. The Seller reserves the right to change the price of goods unilaterally. However, the price of an already confirmed order remains unchanged.

5. Payment Procedure

5.1. The Buyer pays for the goods according to the prices listed in the Online Store at the time of order placement.

5.2. Payment can be made using one of the following methods:

Online payment through payment systems;

6. Delivery of Goods

6.1. Delivery of goods is carried out within Ukraine using the Nova Poshta service.

6.2. The shipping cost is calculated according to the selected courier service's rates and is paid by the Buyer upon receipt.

6.3. Delivery times depend on product availability in stock and the schedule of the courier service.

7. Rights and Obligations of the Parties

7.1. The Seller undertakes to:

Transfer the goods to the Buyer in accordance with this Agreement;

Provide the Buyer with all necessary product information.

7.2. The Buyer undertakes to:

Pay for and accept the ordered goods in a timely manner;

Provide accurate and truthful information necessary for order fulfillment.

8. Exchange and Return of Goods

8.1. Printed editions, including magazines, zines, and books, are not subject to return in accordance with Annex No. 3 to the Resolution of the Cabinet of Ministers of Ukraine dated March 19, 1994, No. 172 "On the Implementation of Certain Provisions of the Law of Ukraine 'On Consumer Rights Protection.'"

9. Liability of the Parties

9.1. The Seller is responsible for the quality of goods in accordance with current Ukrainian legislation.

9.2. The Buyer is responsible for the accuracy of the information provided when placing an order.

9.3. In case of violation of this Agreement, the parties shall bear liability as established by Ukrainian law.

10. Force Majeure

10.1. The parties are released from liability for non-performance of obligations under this Agreement in cases of force majeure, including natural disasters, war, strikes, government actions, etc.

11. Duration of the Agreement

11.1. This Agreement comes into effect upon order placement by the Buyer and remains valid until both parties fulfill their obligations.
